Spouse Visa and Extension

A UK Spouse Visa allows non-British partners to join their spouse or civil partner residing in the UK. This visa is typically granted for an initial period of 2 years and 6 months, after which you may apply for an extension to continue your stay.

Eligibility Criteria for a UK Spouse Visa

To qualify for a UK Spouse Visa, you must meet the following requirements:

  1. Relationship Requirements:

    • You and your partner must be at least 18 years old.
    • You must be legally married or in a civil partnership recognized in the UK, or have been living together in a relationship akin to marriage for at least 2 years.
  2. Financial Requirements:

    • Your UK-based partner must have a minimum gross annual income of £29,000. Alternatively, substantial savings can be used to meet this requirement.
  3. English Language Proficiency:

    • You must demonstrate English language proficiency by passing an approved English language test at the A1 level or higher, or by having an academic qualification taught in English.
  4. Accommodation:

    • You must have adequate accommodation arranged in the UK for you, your partner, and any dependents.

Application Process

  • Applying from Outside the UK:

    • Submit an online application through the UK government's official website.
    • Provide necessary documents, including proof of relationship, financial evidence, English language certification, and accommodation details.
    • Attend a biometric appointment at a visa application center in your country.
  • Applying from Within the UK:

    • If you're already in the UK on a different visa, you may be able to switch to a Spouse Visa, provided you meet all eligibility criteria.

Spouse Visa Extension

As your initial Spouse Visa nears its expiration (after 2 years and 6 months), you can apply for an extension to remain in the UK. This extension is also granted for 2 years and 6 months. After completing 5 years on a Spouse Visa, you may be eligible to apply for Indefinite Leave to Remain (ILR), leading to permanent residency. https://www.gov.uk/uk-family-visa

Requirements for Spouse Visa Extension

The requirements for extending your Spouse Visa are similar to the initial application:

  • Continued Relationship:

    • Provide evidence that your relationship is genuine and subsisting, such as joint bank statements, utility bills, or rental agreements.
  • Financial Requirements:

    • You must continue to meet the financial threshold of £29,000 annual income or have sufficient savings.
  • English Language Proficiency:

    • You may need to demonstrate improved English language skills, depending on the level previously attained.

Application Process for Extension

  • Complete the online application form for a Spouse Visa extension.
  • Gather and submit supporting documents, including proof of relationship, financial evidence, and English language certification.
  • Attend a biometric appointment to provide fingerprints and photographs.

Key Considerations

  • Application Timing:

    • Apply for an extension before your current visa expires to maintain legal residency.
  • Document Preparation:

    • Ensure all documents are up-to-date and accurately reflect your current circumstances.
  • Professional Guidance:

    • Consider seeking advice from immigration professionals to navigate the application process effectively.
