Unmarried Partner Visa

An Unmarried Partner Visa allows individuals in a committed, long-term relationship with a British citizen or someone settled in the UK to join their partner without the necessity of marriage or civil partnership. This visa category acknowledges relationships akin to marriage, provided specific criteria are met.

Eligibility Criteria

To qualify for an Unmarried Partner Visa, you and your partner must:

  1. Age Requirement: Both be 18 years of age or older.

  2. Relationship Duration: Have lived together in a relationship akin to marriage or civil partnership for at least two years prior to the application.

  3. Genuine and Subsisting Relationship: Demonstrate that your relationship is genuine and ongoing.

  4. Intent to Live Together: Intend to live together permanently in the UK after the application.

  5. Previous Relationships: Ensure any prior marriages or partnerships have permanently ended.

  6. Financial Requirements: Meet the financial threshold, typically a minimum annual income of £18,600. This amount increases if you have dependent children.

  7. English Language Proficiency: Prove knowledge of the English language, usually by passing an approved English language test at the A1 level or higher.

  8. Accommodation: Have adequate accommodation arranged in the UK for you, your partner, and any dependents.

Application Process

  1. Online Application: Complete the appropriate online application form based on your location (inside or outside the UK).

  2. Payment of Fees: Pay the visa application fee and the Immigration Health Surcharge (IHS), which grants access to the National Health Service (NHS).

  3. Biometrics Appointment: Schedule and attend an appointment to provide your fingerprints and photograph.

  4. Supporting Documents: Submit evidence supporting your application, including proof of relationship, financial documents, accommodation details, and English language proficiency.

  5. Await Decision: After submission, wait for the Home Office to process your application. Processing times can vary, so it's advisable to apply well in advance of any planned travel.

Required Documentation

  • Proof of Relationship: Joint tenancy agreements, utility bills, or correspondence addressed to both partners over the past two years.

  • Financial Evidence: Bank statements, payslips, or a letter from your employer confirming your income.

  • Accommodation Details: Documents demonstrating adequate housing arrangements in the UK.

  • English Language Certification: Results from an approved English language test, if applicable.

Post-Visa Approval

If your application is approved, you'll receive a visa valid for 30 months (2.5 years). During this period, you can work and study in the UK. Before your visa expires, you must apply for an extension to remain in the UK. After five years of continuous residence, you may be eligible to apply for Indefinite Leave to Remain (ILR), leading to permanent settlement.

Common Challenges and Considerations

  • Evidence of Cohabitation: Providing sufficient proof of living together for two years can be challenging, especially if you've spent time apart. Collect and maintain joint documents to support your application.

  • Financial Threshold: Ensure you meet the financial requirements, as failing to do so can result in visa refusal.

  • English Language Requirement: Prepare adequately for the English language test to meet the necessary standards.
